These terms govern your use of Schoolwati. By creating an account or continuing to use the platform after we have notified you of a change, you agree to be bound by them. We have kept the language plain so a school administrator (not just a lawyer) can read and understand the agreement.
The short version. Use the platform as intended. Pay your subscription on time. Your school owns its data and can export or delete it at any time. We provide the service "as is" with commercially reasonable effort. Disputes are governed by Indian law.
1. Who these terms are between
These terms are between you (the institution that subscribes to Schoolwati, referred to as "you" or "your school") and Bytesar Technologies Private Limited (referred to as "Schoolwati", "we", or "us"). If you are signing up on behalf of a school, you confirm you have the authority to bind that school to these terms.
2. What Schoolwati provides
Schoolwati is a cloud-hosted school management platform. The exact set of features your school can use depends on the plan you subscribed to. Plans, pricing, and feature lists are shown on the pricing page and may evolve over time. We will not remove features included in your active plan for the duration of your current billing period without at least thirty days' notice.
3. Your account
3.1 Account responsibilities
- You are responsible for maintaining the confidentiality of your institution's administrator credentials.
- You are responsible for the activity of every user account your institution creates inside the platform.
- You will notify us promptly at support@schoolwati.com if you discover any unauthorized access to your account.
3.2 Eligibility
You must be a registered educational institution or a person authorized to manage one. Individuals under 18 may use the platform only through an account created by a parent or guardian's institution (e.g. parent accounts created by a school).
4. Subscription and payment
4.1 Subscription term
Subscriptions are billed annually by default. Other billing cadences (quarterly, monthly) are available on request. Subscriptions renew automatically unless cancelled at least thirty days before the renewal date.
4.2 Payment
Payments are processed through our payment partner. Indian schools may pay by NEFT, bank transfer, UPI, or supported card methods. Payments are due in advance of each subscription period.
4.3 Late payment
If a payment is more than fifteen days overdue, we may suspend access to write operations (creating new records) while preserving read access. If payment remains overdue beyond forty-five days, we may suspend the account fully. Your data is retained in either case and access is restored on payment.
4.4 Taxes
Prices are exclusive of taxes. GST is added at the applicable rate on Indian invoices.
4.5 Refunds
Subscription fees are non-refundable except where required by Indian law. If we materially fail to deliver the service for which you paid, contact us and we will work out a credit or refund in good faith.
5. Your data
5.1 Ownership
You own your data. Schoolwati does not claim ownership of student records, staff records, financial data, or any other content your school stores on the platform. We only act as a processor on your behalf, as detailed in our privacy policy.
5.2 Export and deletion
You can request an export of your data at any time by raising a support ticket. We deliver the export in standard spreadsheet format, typically within one business day. You can request deletion of individual records from inside the platform, and full account deletion through support.
5.3 Backups
We maintain encrypted backups for disaster recovery. Backups are not a substitute for your own records - we recommend periodic exports for your school's records.
6. Acceptable use
You agree not to:
- Use Schoolwati to store unlawful, defamatory, or infringing content.
- Attempt to access another school's data, scan the platform for vulnerabilities without prior written permission, or circumvent access controls.
- Resell, sublicense, or white-label the service without an explicit written agreement.
- Use the platform to send unsolicited bulk messages outside the normal flow of school-parent communications.
- Upload malware or attempt to disrupt the service for other tenants.
Violations may result in suspension or termination of the account. Severe violations (security attacks, large-scale unauthorized access attempts) may also be reported to law enforcement.
7. Service availability
We use commercially reasonable effort to keep the platform available. Brief maintenance windows are scheduled outside Indian school hours whenever possible. No internet-hosted service can guarantee uninterrupted availability, and we do not guarantee a specific uptime percentage as part of these standard terms - enterprise plans can include a written SLA on request.
8. Suspension and termination
8.1 Suspension
We may suspend access if (a) payment is overdue, (b) the account is being used in violation of these terms, or (c) we have a good-faith belief that suspension is necessary to protect the platform or other tenants from harm. We will explain the reason in writing.
8.2 Termination by you
You may cancel your subscription at any time. The account remains active through the end of the paid period. Data export is offered before the account is deactivated.
8.3 Termination by us
We may terminate the agreement for cause if you materially breach these terms and the breach is not cured within thirty days of written notice. A full export of your data is offered before termination takes effect.
9. Disclaimers
Schoolwati is provided "as is" and "as available." We make no warranties beyond those that cannot be excluded under Indian law. We do not warrant that the platform will be uninterrupted, error-free, or fit for any particular purpose beyond its general description as a school management system.
10. Limitation of liability
To the maximum extent permitted by Indian law, our total liability for any claim arising from or related to these terms or your use of Schoolwati is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages (such as lost profits or lost data, except where required to be liable under Indian law).
These limits do not apply to liability that cannot be limited under Indian law - for example, liability for fraud or for personal injury caused by our negligence.
11. Indemnification
You will defend and indemnify us against any third-party claim arising from your school's use of the platform in violation of these terms, of Indian law, or of any third-party rights - including, for instance, a claim from a parent that you uploaded a student's information without proper authorization. We will defend and indemnify you against any third-party claim that the platform itself, when used as intended, infringes that third party's intellectual-property rights.
12. Changes to these terms
We will post any changes on this page and update the "Last updated" date at the top. For changes that materially affect your rights or obligations, we will notify institution admins through an in-app banner and, where we have a current contact email, by email at least thirty days before the change takes effect. Continuing to use the platform after the effective date constitutes acceptance of the revised terms.
13. Governing law and disputes
These terms are governed by the laws of India. Any dispute arising out of or in connection with these terms will be submitted to the exclusive jurisdiction of the courts at Pune, Maharashtra.
We always prefer to resolve disputes through direct conversation. Before initiating any formal proceedings, please write to support@schoolwati.com describing the issue. We commit to responding substantively within ten business days.
14. Miscellaneous
- Entire agreement. These terms, together with our privacy policy and any signed order form, are the entire agreement between us regarding the platform.
- Severability. If a court finds any provision unenforceable, the rest of the terms remain in effect.
- Assignment. You may not assign these terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of substantially all of our assets, on notice to you.
- Notices. Notices to you are given through in-app banners or to the contact email on your account. Notices to us are given by email to support@schoolwati.com.
